Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Bradnova Technologies Ltd. ("Bradnova", "we", "us"), governing your access to and use of the NovaEnglish platform, website, and mobile applications (collectively, the "Service").

By creating an account, accessing the Service, or clicking “I agree”, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not use the Service.

NovaEnglish is an online English language learning platform that provides:

• AI-powered CEFR-aligned English language assessments
• Personalised study plans and learning recommendations
• Practice activities across grammar, vocabulary, reading, and listening skills
• A library of educational resources including articles, guides, worksheets, and downloadable PDFs
• Progress tracking, achievement systems, and milestone rewards
• Tools for English tutors to manage student progress (Tutor plan)

The Service is provided on an “as is” and “as available” basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To access most features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and not share it with third parties
• Notify us immediately of any unauthorised use of your account at hello@novaenglish.com
• Be responsible for all activity that occurs under your account

You must be at least 13 years old to create an account. Users between 13 and 17 must have parental or guardian consent. We reserve the right to terminate accounts that provide false information or violate these Terms.

You may not create more than one account per person without our express written permission. Multiple accounts created to circumvent restrictions or bans may all be terminated.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use the Service to violate any applicable local, national, or international law or regulation
• Transmit any material that is abusive, defamatory, obscene, hateful, or discriminatory
• Attempt to gain unauthorised access to any part of the Service, our servers, or any systems connected to the Service
• Use automated bots, scrapers, or other automated tools to access, collect data from, or interact with the Service without our prior written consent
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Share your account credentials or allow others to access the Service using your account
• Use AI-generated content to circumvent assessment integrity or cheat on evaluations

Violation of this Acceptable Use policy may result in immediate suspension or termination of your account.

5.1 Plans

NovaEnglish offers three plans: Starter (free), Learner Pro, and Tutor. Features available under each plan are described on our Pricing page. We reserve the right to modify plan features or pricing with at least 30 days' notice to existing subscribers.

5.2 Free trial

Paid plans include a 7-day free trial. No credit card is required to start a trial. If you do not cancel before the trial period ends, your card will be charged for the applicable plan at the standard rate.

5.3 Billing

Subscription fees are charged in advance on a monthly or annual basis, depending on your selected billing cycle. Payments are processed securely by Stripe. All prices are displayed in USD unless otherwise stated and are exclusive of any applicable taxes.

5.4 Refunds

We offer a 14-day money-back guarantee for new paid subscriptions. If you are not satisfied within 14 days of your first charge, contact hello@novaenglish.com for a full refund. After 14 days, subscription fees are non-refundable except where required by applicable law.

5.5 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

The Service and all content within it — including but not limited to text, graphics, logos, icons, images, audio clips, assessment questions, articles, and software — are the property of Bradnova Technologies Ltd. or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial educational purposes.

You may not: reproduce, modify, distribute, transmit, or create derivative works from any content from the Service without our prior written consent; remove any copyright, trademark, or proprietary notices; or use our trademarks, logos, or brand elements without permission.

Downloadable PDF resources provided under paid plans are licensed for personal use only. Redistribution, resale, or classroom use beyond personal study requires a separate licence — please contact us for institutional licensing.

The Service may allow you to submit content such as written essay responses, profile information, and communications with our support team ("User Content").

You retain ownership of any User Content you submit. By submitting User Content, you grant Bradnova a worldwide, royalty-free, non-exclusive licence to use, process, and store that content solely for the purpose of providing and improving the Service.

You represent and warrant that: (a) you own or have the rights to submit the User Content; (b) the User Content does not violate the rights of any third party; and (c) the User Content complies with these Terms and all applicable laws.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion.

NovaEnglish uses AI technologies to provide assessment scoring, study plan personalisation, and other features. You acknowledge and agree that:

• AI-generated assessments and recommendations are informational and educational in nature; they do not constitute formal professional qualifications or certifications
• AI scoring may occasionally contain errors. If you believe your assessment score is incorrect, you may contact us for a manual review
• Writing samples you submit for AI evaluation are transmitted to our AI provider (Anthropic) for processing. These transmissions are governed by our data processing agreement with Anthropic and are not used to train AI models
• We are not responsible for decisions you make based on AI-generated recommendations

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Bradnova Technologies does not warrant that: (a) the Service will function uninterrupted, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) any errors in the Service will be corrected; or (d) the Service or its servers are free of viruses or harmful components.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRADNOVA TECHNOLOGIES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Unauthorised access to or alteration of your transmissions or data
• Any other matter relating to the Service

In no event shall Bradnova's total liability to you for all claims exceed the greater of: (a) the amount you paid us in the twelve (12) months prior to the event giving rise to the liability; or (b) €100 EUR.

We may suspend or terminate your access to the Service at our sole discretion, immediately and without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, third parties, or for any other reason.

You may terminate your account at any time from Settings → Account → Delete Account. Upon termination, your right to use the Service will immediately cease.

Sections of these Terms that by their nature should survive termination will survive, including but not limited to: Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Notwithstanding the above, if you are located in the European Union, you have the right to seek alternative dispute resolution through the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
